Des d'aleshores, vam comen\u00e7ar com a notaris a poder actuar en la fase precontractual dels pr\u00e9stecs hipotecaris.\u00a0<\/p>\n\n<p><strong>Quines funcions es realitzen?<\/strong><\/p>\n\n<p>La principal funci\u00f3 del notari en les actes pr\u00e8vies ara exigides \u00e9s, en primer lloc, comprovar que els documents relatius a les condicions del pr\u00e9stec i els seus annexos han estat lliurats en temps i forma al client; i, en segon lloc, fer constar l'assessorament legal que oferim en aquell acte i recollir els dubtes plantejats.<\/p>\n\n<p><strong>Es coneixen les principals caracter\u00edstiques del pr\u00e9stec?<\/strong><\/p>\n\n<p>Durant aquest temps hem pogut comprovar que la majoria dels nostres clients entenen les principals caracter\u00edstiques i condicions del pr\u00e9stec, que s\u00f3n les seg\u00fcents: capital, durada, tipus d'inter\u00e8s fix o variable i les despeses que s'han d'assumir, per\u00f2 hi ha altres conceptes m\u00e9s complexos que conv\u00e9 explicar: com la possible subrogaci\u00f3 i les comissions, per obertura, modificacions, amortitzaci\u00f3 anticipada o reclamaci\u00f3 de quotes impagades.<\/p>\n\n<p><strong>Asseguran\u00e7a de danys sobre l'immoble hipotecat: \u00c9s obligatori?<\/strong><\/p>\n\n<p>Efectivament, l'entitat banc\u00e0ria exigeix disposar d'una asseguran\u00e7a de danys sobre l'immoble hipotecat.\u00a0<\/p>\n\n<p>En aquest cas concret, expliquem als nostres clients que la llei permet que l'entitat creditora pugui exigir-los que la tinguin contractada (i tamb\u00e9, encara que \u00e9s menys freq\u00fcent, una asseguran\u00e7a en garantia del compliment de les obligacions del contracte de pr\u00e9stec) per\u00f2 amb un advertiment important: hi ha llibertat de contractaci\u00f3 d'aquestes assegurances, de tal manera que no \u00e9s obligatori haver de contractar-les amb l'empresa que l'entitat prestadora dicti.<\/p>\n\n<p><strong>Domiciliar la meva n\u00f2mina? I la pensi\u00f3 o rebuts?<\/strong><\/p>\n\n<p>A <a href=\"https:\/\/notariarequena.es\/ca\/\">NOTARIA CRISTINA REQUENA<\/a> els clients pregunten habitualment si \u00e9s obligatori tenir domiciliada la n\u00f2mina, pensi\u00f3 o rebuts peri\u00f2dics (com ara de l'aigua, llum o tel\u00e8fon) en un compte obert a l'entitat creditora, o si han de contractar altres assegurances (de vida, salut o d'autom\u00f2bil) i\/o plans de pensions o productes d'inversi\u00f3 amb la companyia que aquesta designi.<\/p>\n\n<p>En tots els casos anteriorment citats, incidim en que la contractaci\u00f3 d'aquests productes o serveis anomenats de venda combinada, no \u00e9s obligat\u00f2ria. Encara que solen ser condicions perqu\u00e8 l'entitat banc\u00e0ria apliqui una bonificaci\u00f3 al tipus d'inter\u00e8s pactat, per la qual cosa, en complir-les, la quota del pr\u00e9stec es redueix.
