NATIONALITY OATH BEFORE A NOTARY

Since last September, it has been possible to take the Spanish Nationality Oath before a notary or at the Spanish Consulate if you are in a foreign country. 

 

This provides an alternative to the Civil Registry. The significant delays in appointment processes at the Civil Registry, along with the introduction of the new Civil Registry law, have allowed notaries to carry out this important procedure. 

 

What is the Nationality Oath?

 

The well-known Nationality Oath refers precisely to the declaration of intent regarding nationality and civil residence. It is the final step an immigrant must take to ultimately obtain Spanish nationality. 

 

Once the Nationality Oath is taken, the next step is to register with the Civil Registry as Spanish citizens, in order to issue the corresponding Birth Certificate. 

Oath or Promise?

The individual, according to their beliefs or preference, can choose between the oath or the promise. Both have the same validity under the law. 

What documentation is required?

  • Nationality grant resolution.
  • Birth certificate from the country of origin.
  • Criminal record certificate from the country of origin.
  • Valid passport.

All foreign documents must be accompanied by a sworn translation into Spanish and be apostilled if necessary.

 

How much time do I have to complete this process?

 

Once Spanish nationality is granted and you receive the corresponding notification, you will have a maximum period of 180 days to complete it.

What questions are asked during the Oath of Nationality?

The Oath of Nationality is a formal act in which the foreign citizen primarily answers whether they swear allegiance to the King, the Spanish legal system, and to its laws. 

Do I have to renounce my nationality to acquire Spanish nationality?

Yes, as long as the country in question does not have a dual nationality agreement with Spain. In that case, such renunciation will not be necessary. On the Ministry of Justice website, you can check which countries have this agreement with Spain.
